Cooks and cooking teams agree to terms...

Please read all of the following terms and conditions carefully, once you sign and send in your application, you will be bound by these terms.

Any photos taken by the chamber of you or your site and your responses to this application become the property of the Morgan Hill “No Bull” BBQ Cook-­Off and may be used for promotional purposes. Contestants agree to indemnify and hold the Morgan Hill “No Bull” BBQ Cook-­Off Board harmless from any and all claims made against the Board, including, without limitations, all costs, liabilities, judgments, expenses, damages, or reasonable attorney’s fees arising out of or in connection with (1) any structure erected by the contestant, (2) any apparatus, equipment, or personal property used by contestant, (3) any act or omission to act of contestant, its agents, invitees, participants, representatives, employees, servants, and agents, and (4) any claims made on account or resulting from contestant’s participation in the contest. A complete set of the rules and regulations and other information will be emailed upon request.

1. The head cook will be responsible for the team having a fully functional Fire Extinguisher rated no less than 2A:10B:C within the confines of their cooking area. This fire extinguisher must either have been certified in the last year (from the date of the event) or must be able to provide a purchase receipt date no less than 1 year ago. Additionally any entrant using a generator will also need a 40B:C fire extinguisher placed near the generator.

2. The head cook agrees to be available at the cooking site for a scheduled Fire Inspection, if required.

3. If you plan to have an RV present, you are required to let us know at the time you submit your entry, or be prepared to have it some distance from your cook site.

4. WAIVER OF LIABILITY: I agree to indemnify, defend and forever save and hold harmless Morgan Hill chamber of Commerce, City of Morgan Hill, CBBQA, Ben Lobenstein, Fire It Up! Events, Ric Gilbert, KCBS and its affiliates and related entities, and their respective principals, shareholders, members, partners, officers, directors, employees, representatives, tenants, agents, assigns, contractors and volunteers (sometimes collectively referred to herein as the “No Bull Indemnities” and individually as a “No Bull Indemnities”), from and against any and all damages, claims, losses, demands, costs, expenses (including attorneys’ fees and costs), obligations, liens, liabilities, actions and causes of action, threatened or actual, which any one of the No Bull Indemnities may suffer or incur arising directly or indirectly out of or in connection with the provision of the products and services or the failure of anyone to provide the products and services in accordance with the terms of this agreement, except to the extent arising from the direct negligence or willful misconduct of any of the above. The foregoing indemnification shall survive any termination or the expiration of the term of this agreement.

6. I hereby grant full permission to the event organizers and/or agents authorized by them to use any photographs, video tapes, recordings or any other record of the event for any legitimate purpose.

7. In addition, I agree to abide by all rules as posted and take full responsibility for the behavior of my team members and associated guests.

Any team once bound by these terms, which is found to have broken them can and may be subject to immediate disqualification from the event/contest without refund.

I understand that there are a limited number of teams able to participate in this event, and I understand that the sending of this application and payment does not guarantee me or my team’s entry into this event. You will be notified (either directly or by public posting on the website) when your team is accepted in this event. If for any reason your entry is not accepted your entry fee will be refunded within 30 days of this decision. An official copy of these terms shall be posted at all times on the event website (above) and may be updated from time to time without further notice.
I agree to be bound by the terms and conditions listed above, as well as the 2010 Rules and Regulations of the Kansas City Barbeque Society, and would like to participate in this BBQ contest.
